The subject of this appeal is a wrongful death action arising out of a collision between a motor vehicle operated by the plaintiff's decedent and a stationary, unoccupied truck owned by the defendant department of transportation (DOT). The sole issue on appeal is whether the trial court erred in granting a summary judgment in favor of the DOT.1
