Appellate Division of the Supreme Court of the State of New York, Second Department.

Ordered that the judgment is reversed, on the law, the first count of the indictment charging the defendant with manslaughter in the second degree is dismissed, and a new trial is ordered on the second count of the indictment charging the defendant with criminally negligent homicide and on the third count of the indictment charging the defendant with leaving the scene of an accident. The facts have been considered and are determined to have been established.
