Justice O'CONNOR delivered the opinion of the court:

Defendant Lonnie Green was found guilty of murder pursuant to Ill.Rev.Stat. 1979, ch. 38, par. 9-1(a)(2), for the death of David Irons. The trial court sentenced Green to forty years in the Illinois Department of Corrections. Green appeals. For the reasons below, we affirm Green's conviction and sentence, but reverse the dismissal of his post-conviction petition.
