Defendant Gary Preston (Preston) and Richard Stutson (Stutson) were charged by bill of information with possession of cocaine. Originally, both Preston and Stutson pleaded not guilty, but Stutson later changed his plea to guilty. Preston was tried by a six person jury on November 14, 1988, and was found guilty as charged. Following the denial of his motion for a new trial, on December 2, 1988, Preston was sentenced to five years at hard labor. The...
