PER CURIAM.

The prosecution appeals as of right from a Kalamazoo Circuit Court order dismissing three counts of first-degree criminal sexual conduct, MCL 750.520b; MSA 28.788(2), against defendant. We affirm.

Defendant is a twenty-seven-year-old associate engineer employed by Kellogg Company of Battle Creek, Michigan. Kellogg provides an "Employee Assistance Program" for its employees. According to company brochures...
