Defendant, Jasper Green, was charged and later convicted in a judge trial of distribution of a controlled dangerous substance, to wit: marijuana, in violation of LSA-R.S. 40:966(A)(1) and (B) and LSA-R.S. 40:964 I, C. He was sentenced on July 25, 1989 to serve three years at hard labor and to pay a $2,000 fine, or in default thereof, the defendant would serve one year in parish jail consecutive to any other sentence imposed.
