The people appeal as of right the Allegan Circuit Court order dismissing the charge of first-degree criminal sexual conduct, MCL 750.520b(1)(a); MSA 28.788(2)(1)(a), against defendant. The court dismissed the charge because, it concluded, the statute of limitations which was in effect at the time the alleged offense occurred controlled and such time period had expired at the time the warrant was issued in this case.
