Defendant Mary Ann Maiorana appeals from her conviction of misconduct in office (N.J.S.A. 2C:30-2), upon which she was sentenced to a term of three years. She was acquitted of theft by deception. She also appeals from denial of her motion to dismiss count two of the indictment which is reported as, State v. Maioranna, 225 N.J.Super. 365,
