HERD, J.:

This is a criminal action wherein Louis Beans was convicted by a jury of rape, K.S.A. 21-3502, and aggravated burglary, K.S.A. 21-3716. Beans was sentenced under the habitual criminal act for thirty years to life on the rape charge and five to ten years for aggravated burglary. The sentences are to run consecutively.
