Plaintiff, Kathleen O'Hara, brought a negligence action against, amongst others, Holy Cross Hospital (Holy Cross) and Emergency Medicine, S.C. (Emergency Medicine). The circuit court granted Emergency Medicine's motion for summary judgment on the basis that it did not owe plaintiff a duty of due care, and plaintiff appealed.
