In this appeal, we consider (1) whether the Industrial Commission erred in failing to dismiss the claimant's application for workers' compensation benefits upon the employer's plea of res judicata1, and (2) whether the finding of the Industrial Commission that the claimant failed to carry the burden of proof imposed by Code § 65.1-46.1 was supported by the evidence.
