ABRAMS, J.

William Brown was indicted in 1988 for the murder in the first degree of a twelve year old child in 1980 and for rape of a child by force. See G.L.c. 265, § 1; G.L.c. 265, § 22A. A jury trial commenced in the fall of 1988. Brown moved for required findings of not guilty at the conclusion of the Commonwealth's case. The judge denied Brown's motion. After three days of deliberation, the jurors informed the judge that they could not reach any verdicts...
