In this appeal we decide whether a spouse may reinstitute a divorce suit in Virginia after that spouse had previously filed and voluntarily nonsuited a divorce suit in a foreign jurisdiction. Mrs. Clark contends that the Petersburg circuit court should have declined to hear the husband's bill of complaint for divorce because he had previously filed and nonsuited a similar complaint in Switzerland.
