On July 17, 1987, defendant was indicted for the crimes of which he was ultimately convicted. These charges stemmed from a sale of cocaine which took place on July 2, 1987 at approximately 6:15 P.M. at the rear of 64 Essex Street in Manhattan. Three police officers in an unmarked police van stopped at a red light observed as defendant handed a glassine envelope containing white powder to one Sylvia Rivera.
