This is an action asserting claims for malicious prosecution and breach of contract. It stems from defendant Harold Reed's attempt to enjoin plaintiff Crown Wisteria (Crown), owned by plaintiff Stamell, from constructing an addition to a town-house, in violation of a restrictive covenant in a deed which prohibited any additions so long as the Reeds "occupied" the adjoining building.
