Contrary to the finding of the Supreme Court, the record fails to establish the existence of triable issues of fact warranting the denial of defendant Rosenberg's motion and defendant Pomeranz' cross motion for summary judgment. Instead, the record reveals that the deceased, Henrietta Sofsky, and defendant David Rosenberg were co-owners of a lingerie business as well as close personal friends from the late 1940's until Mrs. Sofsky's death in 1982.
