Appellant, Robert Henry Rigenstrup, was indicted on two counts of cruelty to children. The alleged victim (hereinafter "B") is the daughter of the woman with whom appellant was living, Renee Pence. Count one averred that appellant "unlawfully maliciously" caused B "cruel and excessive physical and mental pain by striking said child on the buttocks, about the head and about the body."
