Appellee was indicted for two counts of violating the Georgia Controlled Substances Act and he filed a pre-trial motion to suppress. The trial court, relying upon Hill v. State, 193 Ga.App. 280 (387 S.E.2d 582) (1989), granted appellee's motion and the State appeals from that order.
