CYNAR, J.

Defendant appeals as of right from a circuit court order granting plaintiff summary disposition on its construction bond claim. We affirm.

The facts in this case are not in dispute. Granger Construction Company was the primary contractor on a project involving the construction of the Genesee County jail. As required by the Michigan public works bond act, MCL 129.201 et seq.; MSA 5.2321(1)
