Brian Smith filed a complaint under 42 U.S.C. § 1983 on May 6, 1988, the day following his termination as a police officer for the Town of Eaton. Mr. Smith's complaint asserted that his dismissal violated his constitutional right to procedural due process, substantive due process, and equal protection.
