Before the Court is the motion of plaintiff, TransAmerican Refinery Corporation ("TRC"), for summary judgment. TRC is the successor to GHR Energy Corporation. Plaintiff bases this motion on recent Louisiana Supreme Court jurisprudence,1 which TRC asserts makes its claims of failure to warn, as a matter of law, not prescribed.
