The question raised in this appeal is whether a jurisdictional provision contained in the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 ("FIRREA" or "the Act"), Pub.L. No. 101-73, 103 Stat. 183, 216-17 (1989), codified at 12 U.S.C. § 1819 (1989), applies to an action that was already pending on the date of FIRREA's enactment. The district court held that it does not. We are unable to agree.
