OPINION

MATTHEWS, Chief Justice.

On March 30, 1984, Hiroko Yabuki suffered injuries to her lower back and legs when a step in the stairway to her apartment collapsed. In the lawsuit which she and her husband brought against the owner of the building, E.M. Babinec, the jury awarded her $550,000 and her husband $50,000. Babinec made a timely motion for a new trial and remittitur and subsequently made two motions for relief from judgment under Civil Rule 60...
