ATKINS, Senior District Judge:

These two actions were brought by a union member for violation of Title I of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), 29 U.S.C. § 401 et seq. ("Pruitt I"), and for fraud and wrongful refusal to instate ("Pruitt II"). The district court in each case granted summary judgment in favor of the appellees, and the appellant appealed.
