This action is brought under the Fair Labor Standards Act ("FLSA"), 29 U.S.C. §§ 201 et seq. Plaintiff alleges that on May 13, 1985, he was discharged by defendant for failure to comply with a supervisor's order that he remain at a meeting which was being held when plaintiff was not on duty and for which plaintiff was not to be paid.
