This action arose out of the arrest of the plaintiff, Roman A. Grochowski, by the defendant, Thomas S. DeWitt-Rickards. On August 25, 1987, Rickards arrested Grochowski for driving under the influence of alcohol, in violation of § 18.2-266 of the Code of Virginia.
