KELLEHER, Justice.

In 1986 Stephen Pailin (Pailin) was indicted on a charge that he had murdered Sim Strong (Strong). After a lengthy trial, a Superior Court jury returned a verdict of guilty to the charge of second-degree murder. Pailin's motion for a new trial was denied. Subsequently the trial justice imposed a forty-year sentence, with fifteen of those years suspended. Pailin was to be placed on probation...
