Plaintiff Joslyn Manufacturing Co. (Joslyn), owner of U.S. Patent 4,161,012 ('012), High Voltage Protection Apparatus, brought suit on July 27, 1989, against defendant Amerace Corporation (Amerace) claiming that Amerace infringed the '012 patent by manufacturing and selling certain surge arresters (ESA arresters). Amerace now moves to dismiss this complaint under Rule 12(b)(3) of the Federal Rules of Civil Procedure...
