PER CURIAM:

Sidney Anderson appeals his conviction for violating the "burn" statute, RCW 69.50.401(c). The State filed a motion on the merits. A Commissioner of this court granted the motion and affirmed the conviction. Anderson then filed a motion to modify the Commissioner's ruling. We deny the motion to modify and affirm the conviction.
