James Kelley sued his employer, Sun Transportation Company (Sun), for injuries suffered during the course of work on a towboat on the Missouri River. The suit was based on the Jones Act, 46 U.S.C.App. § 688. On July 6, 1988, the district court, hearing the case without a jury, entered judgment in favor of the plaintiff. Total damages were calculated to be $237,950.00. The judgment against Sun was lowered by 25% to $178,463.00 to reflect...
