This case comes to us from the refusal of a district court judge to disqualify himself on the motion of a criminal defendant whom the judge had previously sentenced in connection with a similar crime. The trial judge held that because his knowledge of the defendant was all gained in judicial proceedings, he was not required to recuse himself under 28 U.S.C. § 144. We agree, but hold that the trial judge was required to determine...
