In the present wrongful death action Anita Patenaude Dunning asserts a medical malpractice claim premised on Dr. Marvin Kerzner's negligent failure to diagnose the colon cancer which precipitated the death of her husband. Following a seven day trial in the United States District Court for the District of Rhode Island, the jury returned a verdict for the defendant physician.
