This matter comes before the court on defendants' motion for summary judgment, filed October 5, 1990. Jurisdiction is based upon 28 U.S.C.A. § 1332(a) (West Supp. 1990). For the reasons below, defendants' motion is hereby GRANTED IN PART AND DENIED IN PART.
