Merton G. Henry, Guardian Ad Litem (Guardian) for the minor and unborn descendants of Hartley W. Mason, appeals a decision by the York County Probate Court (Brooks, J.) upholding the validity of two testamentary trusts created by Mason's will. The court determined that the trust created in Article 7 of the will is a valid charitable trust, and that the trust created in Article 9 of the will does not violate the Rule Against Perpetuities.
