BACKGROUND

Plaintiffs in this action challenge the refusal of the Department of Labor ("Labor") to certify as eligible to apply for worker adjustment assistance the former employees of the Amstar Sugar Corporation's Bunker Hill sugar refining plant in Charlestown, Massachusetts.
