MEMORANDUM OPINION AND ORDER

ROSZKOWSKI, District Judge.

This action comes before the Court on the parties' cross-motions for summary judgment. For the reasons set forth in the opinion below, this Court grants plaintiffs' motion for summary judgment and orders the commodity sod to be included in the definition of "other perishable commodities" as set forth by the United States Department of Agriculture in their Special Agricultural Workers regulations.
