The defendant, John Leary, was convicted after a jury trial in the Superior Court (Dunn, J.) of driving while intoxicated, subsequent offense, RSA 265:82 (Supp. 1989), operating without proof of financial responsibility, RSA 263:63, and simple assault, RSA 631:2-a. On appeal, he argues that the trial court erred in denying his motion to suppress evidence obtained subsequent to his warrantless arrest. For reasons that follow, we affirm.
