This court previously granted Terrance Sikes' petition for writ of habeas corpus by unpublished order. We now publish this opinion to make known our reasons for granting relief.

Sikes was arrested on May 29, 1990, for possession and purchase of cannabis. He made a first appearance on the following day and bail was set at $5,003. That bond was posted and petitioner was released. On June 12 an information was filed charging him with purchase of cannabis...
