Before the court is a motion for summary judgment filed by the defendant, Mutual Benefit Life Insurance Company. The defendant seeks summary judgment dismissing plaintiff's claim for accidental death insurance benefits. The defendant also seeks to strike plaintiff's claims for bad faith and punitive damages.
