This case is currently before the court on the defendant's motion to dismiss the two-count indictment against him. On October 18, 1989, the defendant Readie Van Smith was charged with possession with intent to distribute more than 5 grams of "crack" cocaine, a violation of 21 U.S.C. § 841(a), and use of a firearm during the commission of a drug offense, a violation of 18 U.S.C. § 924(c).
