The defendant, Benjamin Daughtery, was indicted by a Vermillion Parish grand jury for first degree murder, a violation of La.R.S. 14:30. The indictment was subsequently amended to charge second degree murder, a violation of La.R.S. 14:30.1. The defendant pled not guilty and elected trial by jury.
