No. 13545.

785 P.2d 941 (1990)

STATE of Hawaii, Plaintiff-Appellee, v. Hwa Cha KIM, Defendant-Appellant, and Chong Cha Long, Defendant.

Supreme Court of Hawaii.

January 22, 1990.

Attorney(s) appearing for the Case

Jonathan Ezer (Alvin T. Sasaki, on brief), Ezer & Sasaki, Honolulu, for defendant-appellant.

Vickie L. Silberstein, Deputy Pros. Atty., Dept. of Pros. Atty., Honolulu, for plaintiff-appellee.

Before LUM, C.J., PADGETT, HAYASHI and WAKATSUKI, JJ., and NAKAMURA, Retired Justice assigned by reason of vacancy.

LUM, Chief Justice.

Defendant-Appellant Hwa Cha Kim (Kim) appeals her conviction for Promoting a Dangerous Drug in the Second Degree, Hawaii Revised Statutes (HRS) § 712-1242(1)(c) (1985). In this appeal, Kim claims that the trial court erred by refusing to grant an instruction to the jury on the procuring agent defense and refusing to give a "special verdict" form to the jury which would have asked the jury if a "sale" of cocaine had transpired.
