MEMORANDUM OPINION AND ORDER

HAIGHT, District Judge:

Plaintiff Haydee Ruiz brings this action for false arrest pursuant to 42 U.S.C. § 1983 and under a theory of common law negligence. The case is before the Court on the motion for summary judgment of defendants Herrera, Earley, Krzeminski and Monroe, and on the motion to dismiss of defendant Burden.
