The appellant was indicted for sexual abuse, in violation of § 13A-5-40(a)(3), Code of Alabama (1975), and capital murder, § 13A-5-40(a)(8), Code of Alabama (1975). He was found guilty of sexual abuse in the first degree and of murder as a lesser offense included in capital murder.
