Defendant, James Berryhill, was charged by bill of information with second degree murder. LSA-R.S. 14:30.1. Defendant pled not guilty and his first trial ended in a mistrial. Subsequently, a twelve person jury found him guilty of manslaughter. LSA-R.S. 14:31.
