This is an appeal from an injunction prohibiting the appellant Secretary of State from placing proposed constitutional amendment "No. 5" on the November 6, 1990, ballot. The appeal was initially filed in this Court but, due to a lack of jurisdiction,1 the cause was transferred to the Missouri Court of Appeals, Western District.
