Lonnie Fred Spinks, Jr., the appellant, was indicted for the unlawful distribution of a controlled substance, in violation of § 13A-12-211, Code of Alabama 1975. The jury found the appellant "guilty as charged in the indictment." The trial judge sentenced him to 20 years' imprisonment, plus 5 years to be served without possibility of parole, in accordance with the enhancement statute, § 13A-12-250, Code of Alabama 1975 (Supp.1989).
