This matter is before the Court on plaintiff Secretary of Labor's motion for summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiff contends that no issues of fact exist and that plaintiff is entitled to judgment as a matter of law. Defendant asserts that factual questions remain concerning the characterization of the May 16, 1988 letter sent by Joe Glaab to the local membership, thereby precluding the entry of summary judgment...
