The appellant, Thomas Lee Matthews, was convicted of unlawfully possessing a controlled substance, cocaine, with the intent to sell by a jury of his peers. The trial judge, finding that the appellant was a persistent offender and he had committed an especially aggravated offense, imposed a Range II sentence consisting of a fine of $5,000 and confinement in the Department...
