SAVOIE, Judge.

Plaintiff, Merit Industrial Constructors, Inc. (Merit), sued defendants, JE Merit Constructors, Inc. (JE Merit) and UMC of Louisiana, Inc., for trade name infringement, seeking damages and preliminary and permanent injunctions enjoining defendants from using the name "Merit" in the field of industrial construction. The trial court denied the request for preliminary injunction and from this ruling, Merit appeals.1
